customer care: acceptable usage policy

This acceptable use policy specifies the actions prohibited and those accepted by SilverFlame GraphX, Inc. ("SilverFlame") to users of the SilverFlame Network. SilverFlame reserves the right to modify the Policy at any time, effective upon posting of the modified Policy.


SilverFlame recognizes as acceptable all forms of data communications across its network, except where Federally subsidized facilities of transport may require limitations, or State/Federal/International Law prohibits. In those cases, use of the network should adhere to the general principle of advancing science and education through interchange of information among research and educational institutions except where specific policy statement exist. In cases where data communications are addressed to recipients outside of the SilverFlame supplied Network and are carried over the regional networks or the Internet, SilverFlame users are advised that acceptable use polices of those other networks apply and may, in fact, limit use. If SilverFlame is informed by Federal/State/International authorities of inappropriate or illegal use of SilverFlame's facilities and/or other networks these determinations will be binding on the Customer.

ILLEGAL USE.

The account holder agrees to use SilverFlame's services only for lawful purposes, in compliance with all applicable laws. The SilverFlame Network may be used only for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

SilverFlame reserves the right to conduct and investigate suspected violations of these guidelines which may include gathering information from the accountholder or accountholders involved, information from the complaining party, as well as examining material on SilverFlame servers. If SilverFlame believes, in its sole discretion, that a violation of these guidelines has occurred, it may take actions which may include, but not limited to, temporary or permanent removal of material from SilverFlame's servers, the cancellation of newsgroup posts, warnings to the accountholder or holders responsible, and the suspension or termination of the account holder(s) responsible. SilverFlame, in its sole discretion, will determine what action or actions will be taken. Violations of these guidelines could also subject the account holder(s) to criminal or civil liability.

The account holder(s) of record is responsible for all use of the account, with or without the knowledge or consent of the account holder(s)

SYSTEM AND NETWORK SECURITY.

Violations of system or network security are prohibited and will not be tolerated, and may result in criminal and civil liability. SilverFlame will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected. System abuse is defined as any use of SilverFlame resources which disrupts the normal use of the system or Internet services of others. Examples of abuse include, but are not limited to:
  1. Posting or transmitting any unlawful, threatening, abusive, libelous, defamatory, obscene, offensive, indecent, pornographic, profane, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any, local, state, federal or international law, including without limitation the U.S. export control laws and regulations, and laws protecting intellectual property including copyright, trademark, trade secret, misappropriation and anti-dilution laws.
  2. The storing, distributing or transmitting any unlawful material on SilverFlame servers including but not limited to direct threats of personal harm, child pornography, and copyrighted, trademarked, and other proprietary material used without proper authorization. The account holder(s) may not post, upload or otherwise distribute copyrighted material on SilverFlame's servers without the consent of the copyright holder. Failure to abide by these guidelines may subject the account holder to criminal as well as civil liability in addition to actions outlined in Use of Services Guidelines above.
  3. Interfering with the proper operation of SilverFlame's systems, including but not limited to, defeating identification procedures, obtaining access beyond that which you are authorized for, and impairing the availability, reliability, or quality of service for other customers.
  4. Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.
  5. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.
  6. Interference with service to any user, host or network including, without limitation, mail-bombing, flooding, deliberate attempts to overload a system and broadcast attacks.
  7. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
The account holder may not store or distribute certain other types of material on SilverFlame's servers including but not limited to, programs containing viruses or trojans and tools to compromise the security of other sites.

PASSWORDS AND IDENTIFICATION.

Each SilverFlame Internet account holder is responsible for the security of his or her password. It is suggested that passwords are at least 6 characters long and contain letters of mixed case and non-letter characters and can not be found in whole or in part, in normal or reverse order, in any dictionary of words in any language.

SilverFlame staff may monitor the security of account holder(s) password at any time and may opt to change the account holder's password at its discretion if it deems such actions are necessary to maintain the integrity of its network.

The account holder agrees that if he or she feels that his or her password has been compromised in any way, the account holder will notify SilverFlame immediately by telephone at 619.232.5555 or email sysadmin@silverflame.com.

If any security violations are believed to have occurred in connection with the account holder's account, SilverFlame has the right to suspend access to the account pending an investigation and resolution. SilverFlame will fully cooperate with any government or legal investigation regarding any aspect of the account holder's account.

The account holder agrees that he or she is the person legally responsible for the use of the account, are at least 18 years of age, to supply us with current and truthful name, postal address and telephone number for our records. The account holder has a continued obligation to keep this information current. The account holder also agrees that he or she is an authorized user of any credit card that the account holder supplies to us and agree that we have an obligation to fully investigate any possible fraudulent credit card or check use.

EMAIL.

Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site.

SYSTEM RESOURCES.

SilverFlame will allocate resources to provide all account holders with the best service possible. SilverFlame may limit, restrict or prioritize access to system resources, includng CPU time, memory, disk space, session length, and number of sessions. In addition, SilverFlame may charge fees for account holders who are intrested in accessing system resources beyond acceptable usage.

SilverFlame may log instances of abuse of system resources and take appropriate actions as outlined in Use of Service guidelines.
